1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the ByteSled website (bytesled.com) and our software products and services (collectively, the "Service"), operated by ByteSled ("we", "us", or "our").
By accessing our website or purchasing a subscription to any of our products, you agree to be bound by these Terms. If you do not agree, do not use our services.
2. Description of Service
ByteSled provides subscription-based software products designed to help businesses automate and manage server infrastructure. Our current products include:
- CyberSage - Host — a Windows software agent that monitors upcoming SSL/TLS certificate expiries, automates renewal on IIS servers via Let's Encrypt, and dispatches email reports on renewal status.
- Database Utility — an optional add-on module for scheduled database cleanup and automated backups across multiple database engines.
- Server Vitals — an optional add-on module for proactive server health monitoring, including CPU, memory, disk, DNS, and third-party endpoint checks.
- Cache Me — an optional add-on module providing a transparent HTTP caching proxy between your frontend and API with no application code changes required.
Add-on modules require an active CyberSage - Host subscription. Access to all products is tied to an active paid subscription and authenticated using the email address registered at the time of purchase.
3. Subscriptions and Billing
Subscriptions to our software products are billed on a monthly basis at the price displayed at the time of purchase. Billing is handled by our payment processor, Paddle. By completing a purchase you agree to Paddle's Terms of Service.
- Subscriptions renew automatically each month unless cancelled.
- You may cancel your subscription at any time via your Paddle customer portal or by emailing solutions@bytesled.com.
- Upon cancellation, your subscription remains active until the end of the current billing period. No partial refunds are provided for unused days.
- ByteSled reserves the right to change pricing with at least 30 days' notice sent to your registered email address.
4. Refund Policy
Our full refund and return policy — covering subscription products, add-on modules, and bespoke project engagements — is set out in our Return & Refund Policy. By purchasing any ByteSled product or service you agree to the terms of that policy.
In summary: a full refund is available within 7 days of your initial subscription purchase. Refunds are not available after 7 days from the original purchase date. See the Return & Refund Policy for full details including add-on modules and bespoke project terms.
5. Licence Grant
Subject to your compliance with these Terms and the maintenance of an active subscription, ByteSled grants you a limited, non-exclusive, non-transferable licence to install and use the applicable software product(s) on servers and systems that you own or operate.
This licence does not permit you to:
- Redistribute, sublicence, sell, or transfer the software to any third party
- Reverse engineer, decompile, or disassemble the software
- Use the software on behalf of third parties without a separate commercial agreement
- Remove or alter any proprietary notices or labels on the software
6. Acceptable Use
You agree to use our software products only on servers and systems for which you have proper authorisation. You must not use the software to:
- Violate any applicable law or regulation
- Circumvent, disable, or interfere with security features of any software or system
- Attempt to gain unauthorised access to our API, infrastructure, or other customers' data
7. Service Availability
We aim to keep the CyberSage API available at all times, but we do not guarantee uninterrupted availability. The CyberSage Agent is designed to operate autonomously and includes a 72-hour offline grace period so that temporary API outages do not interrupt your certificate renewals.
We reserve the right to perform maintenance, updates, or modifications to the service, with or without prior notice.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BYTESLED DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
You are responsible for maintaining appropriate backups and testing certificate renewals in your environment. ByteSled is not liable for any SSL certificate expiry or server downtime arising from misconfiguration, unsupported environments, or service outages.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BYTESLED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF BYTESLED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
ByteSled's total aggregate liability to you for any claims arising under or related to these Terms shall not exceed the total amount you paid to ByteSled in the three months immediately preceding the claim.
10. Intellectual Property
The CyberSage software, including its source code, design, and documentation, is the intellectual property of ByteSled. Nothing in these Terms transfers any ownership rights to you. All rights not expressly granted are reserved by ByteSled.
11. Termination
ByteSled may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms or if we reasonably believe your use poses a security or legal risk. Upon termination, your licence to use the software is revoked and you must uninstall the CyberSage Agent.
12. Governing Law
These Terms are governed by and construed in accordance with the laws applicable to the jurisdiction in which ByteSled operates. Any dispute arising from or relating to these Terms shall be resolved through good-faith negotiation, or if necessary, binding arbitration.
13. Changes to These Terms
We may modify these Terms at any time. When we do, we will update the "Last updated" date above. For material changes we will notify active subscribers by email at least 14 days before the change takes effect. Continued use of the Service after that date constitutes your acceptance of the revised Terms.
14. Consultancy and Bespoke Services
In addition to subscription software products, ByteSled offers consultancy services including system architecture, environment provisioning, and custom software development. These engagements are governed by separate scope agreements and project terms agreed between ByteSled and the client prior to commencement of any work.
Support timelines, deliverables, and pricing for bespoke projects are stipulated in the final project quotation. Extensions to the agreed project scope or support beyond the terms of the original quotation are available on request and subject to negotiation at the time of the request.
These Terms of Service do not apply to bespoke project engagements except where expressly agreed otherwise in the relevant project documentation.
